These general terms and conditions of sale refer to purchases made telematically on the website www.modadistrict.com, hereinafter also referred to as "website".

Acceptance of the general terms and conditions of sale

By placing the order and authorising payment with the means specified on the website, the customer claims to have read the general terms and conditions of sale, delivery and payment, and accepts them without any reservation. These general terms and conditions of sale are an integral part of the sales contract between Centro Calzaturiero s.r.l. and the customer, who is required to print and keep a copy of it on a durable medium.

This contract has been written in Italian and is also available in English. Online purchases are only available to citizens of the European Economic Community. The contents of the website abide by Italian laws and, consequently, the European laws acknowledged by Italy. The prices of all items are offered in Euros. Any support programmes used to convert the values expressed in Euros into other currencies are merely indicative and are not binding. Centro Calzaturiero s.r.l. shall not be held liable, in any way, for exchange rate policies and bank charges applied by the manager of your credit card.

Prices

The prices expressed in Euros and published on the website include VAT. Centro Calzaturiero s.r.l. reserves the right to change, at any time, the published prices with immediate effect. All confirmed orders will maintain the agreed prices.

Legal notices

Centro Calzaturiero s.r.l. owns the website www.centrocalzaturiero.it and www.modadistrict.com, as well as the Centro Calzaturiero brand and logo. Any reproduction or use, for any reason or whatever the medium, without prior written consent shall be prohibited. The reproduction or use, for any reason, of any contents available on the website shall also be forbidden. We shall therefore not be held liable for any direct or indirect damage attributable to improper and unauthorised use of the contents available on the website. Centro Calzaturiero s.r.l. adopts the best technologies available on the market to make sure that all photographic media and images are as true as possible compared to the actual products. Contracts previously concluded and not yet processed will maintain the terms in force at the time the order is completed.

Court of jurisdiction

Centro Calzaturiero s.r.l. is an Italian company and is therefore subject to Italian law. The court of jurisdiction for any disputes that may arise is the Court of Vigevano (PV). By purchasing online, after having read and accepted the general terms and conditions of sale, the customer agrees to be subject to Italian jurisdiction and to the territorial jurisdiction of the Court of Vigevano.

Conclusion of the contract

Once the order has been processed (if the selected form of payment has been successful), Centro Calzaturiero shall notify this by sending an e-mail to the e-mail address registered in "your account". Centro Calzaturiero s.r.l. reserves the right to make changes to the order received as a result of possible variations of availability for the items included in your order. If changes are made to the order, Centro Calzaturiero s.r.l will promptly notify the customer of such changes and of possible refund methods.
This contract is to be considered concluded when notification is sent that the order status is "Awaiting Courier".
If the order is cancelled due to unavailability of goods, Centro Calzaturiero s.r.l. will credit the amount spent again with the same payment method previously used, and the customer shall not be entitled to any rights or to make any further claims. This contract can be downloaded and stored using the appropriate "download" button , or printed on paper using the appropriate "print" button .

Purchase guide

In order to continue your purchase, you must create your own account by accessing the "login" section. You will be asked to login to your existing account, if you are already registered, with your previous credentials or to register if you have never registered before. The following details will be required: a valid e-mail address, a password (to be created), name, surname, full address, tax code and VAT number, if available, telephone number and the acceptance of the general terms and conditions of sale that you will have to read. You can then choose the product you desire, selecting it from the various product categories, pick size and colour and then add the product to the virtual shopping cart. The cart will show in real time the total cost of your purchase, you can then edit and/or delete everything or individual items at any time or continue with the purchase procedure by clicking the order "confirmation" button. The order will then be displayed again and you can proceed to pay and confirm shipping data with a simple and clear procedure.

Terms of payment

Centro Calzaturiero s.r.l. accepts payments in cash on delivery, by credit card (Visa and Mastercard) and by Paypal with which it has signed appropriate agreements. At the time of the transaction, the customer will be redirected to a protected site managed directly by the banking system manager in order to protect customer safety. The personnel in charge or the programs in use do not allow you to view any secret codes required by the procedure. Centro Calzaturiero s.r.l. undertakes to refund any payments made in accordance with any changes to the orders received. The staff of Centro Calzaturiero S.r.l. will not, nor must it ever, ask you for the secret codes of your credit/debit card. For all orders processed with cash on delivery payment methods, an increase of €6.00 will be applied to the total order for management costs, this sum will not be re-credited if a possible return with refund is requested. The customer who will use this payment method must indicate during the return procedure the circuit through which you wish to be refunded, specifying the relevant IBAN or Paypal account.

Unavailability of items

Centro Calzaturiero s.r.l. declines any responsibility if, for any reason, the requested item, confirmed and paid for, should be unavailable at the time the order is processed (by way of example and not limited to: involuntary damage caused by the operator, breakage of the product during packaging, discrepancies between electronic availability and actual availability, theft etc.). Centro Calzaturiero s.r.l. will immediately inform the customer and proceed to credit the payment received again using the normal procedures provided for by the manager of your credit card. If the delivery of the product should not take place within 30 days of the notification of order confirmation, regardless of the reasons that have prevented such delivery, Centro Calzaturiero s.r.l. will credit the payment received again and the customer will undertake to return the product delivered late. The parties may agree on new delivery deadlines.

Shipping methods and delivery times, delivery delays

After confirming the order and checking that payment was successful, Centro Calzaturiero s.r.l. will begin processing the order. Transport to the customer's premises will be dealt with by third-party companies equipped with adequate logistics facilities and means of transport, which will deliver goods within about 10 days time. For orders received from non-CEE countries, Centro Calzaturiero S.r.l. reserves the right to proceed with shipping, even if the order has been accepted and paid for, since special customs procedures may be requested, or restrictive regulations related to the chosen product may be applied, as well as customs duties that were not provided for.
In this case, Centro Calzaturiero S.r.l. will credit again the payment received to the customer using the normal procedures provided for by the manager of your credit card. Centro Calzaturiero S.r.l. declines all responsibility for any delivery delays beyond its control that may be attributed both to Centro Calzaturiero S.r.l. and to third-party carriers in charge of transport such as, but not limited to: strikes, bad weather, accidents, provisions of custody by competent authorities, etc.

Online tracking

If provided for by the carrier, Centro Calzaturiero s.r.l. will communicate the shipping details to the customer in order to track the transport of the ordered goods: "online tracking". Centro Calzaturiero s.r.l. declines any liability in case of malfunctions of the service provided by third parties.

Right of withdrawal

Customers are entitled to withdraw from the contract within 30 days of delivery of the order without giving any reasons. Should it wish to exercise this right, Centro Calzaturiero S.r.l. has set up a dedicated procedure directly online on the website www.modadistrict.com. Simply access your account, find the order (in the order history) for which you are exercising the right of withdrawal (the order can be fully returned, or just a single item in a multiple order), and exercise the right of withdrawal with the dedicated button. A request/fiscal document for "returned goods" will be automatically created, which will be sent to your e-mail address. This document will also be valid as communication to Centro Calzaturiero s.r.l. and to notify our acceptance. Specify in the notes/reason "RIGHT OF WITHDRAWAL" The "returned goods" document must be printed in 2 copies: one inserted in the returned goods pack to allow product identification during the return process, and the other must be delivered to the courier or attached to the outside of the returned package. Customers may choose whether to proceed with shipping using the courier that manages our deliveries (our recommended choice in terms of costs and speed of delivery) or whether to submit the returned goods personally with carriers of their choice. Once the right of withdrawal has been exercised through the appropriate online procedure, the customer will have 30 days time to return the goods. The goods to be returned must be intact, in the same conditions of delivery and must not have been used. The customer will be required to pack the goods in a new package containing the original boxes, labels and any identification codes. Returned goods must be sent to: Centro Calzaturiero S.r.l. Viale Industria, 122 - 27025 Gambolò (PV), Italy. Once the goods have been received, Centro Calzaturiero S.r.l. will check that the products have been returned in compliance with procedures and will credit the amount paid again, deducted from shipping costs, i.e. the total amount if the customer has already paid transport costs. These refunds will be made using the same means of payment used for the initial transaction, unless otherwise agreed in writing by the parties. In any case, additional costs will not be applied as a result of such refund.

Warranty for faulty goods

Centro Calzaturiero s.r.l. guarantees that its products are free from any faults or defects. However, if the customer should find that the product purchased is unsuitable for use due to faults or defects that were not evident at the time of shipping, Centro Calzaturiero will make sure, depending on the extent of damage, to repair or replace it, or if this is not possible or is too costly, it will adequately reduce the price or terminate the contract. Once the fault or defect has been noticed, the customer must promptly notify us (no later than 2 months after delivery) using the same procedure as in the right of withdrawal, specifying in the notes/reason "RETURNED DUE TO DEFECT", followed by a description of the defects found. The procedure for returning goods is just one for both the right of withdrawal and for the return of faulty goods; the only thing that changes is the reason specified by the customer in the notes. Once the goods have been received and the unsuitability for use of the product has been verified, Centro Calzaturiero s.r.l. will proceed as described to repair them within a reasonable period of time, to replace the product with an appropriate price reduction, or to terminate the contract and reimburse the transport costs incurred by the customer. The transport costs for returning the repaired goods, which had been returned for a justified reason, to the customer, will be borne by Centro Calzaturiero s.r.l. If there is no justified reason for returning the goods, we hereby provide a merely indicative example: in cases such as negligent use of the product by the customer, cuts or mechanical abrasions, normal wear of the product due to use, wrong size etc., Centro Calzaturiero s.r.l. will inform the customer and return the product to the customer, charging the expenses with written permission via e-mail to proceed to destroy the goods if their re-delivery should not be convenient.

Changing goods

The right of withdrawal covers all returns of goods, without having to state the reason, within 30 days after delivery.
